Friday, February 14, 2025 - Two police officers are set to be charged with torture and abuse of office over the arrest and detention of a British national at Eastleigh-North Police Station.
Chief Inspector Rebecca Njeri Muraya, the Officer Commanding
Station, and Sergeant Abdisalam Ahmed, who still serves at the station, are
accused of unlawfully ordering the arrest of Ayni Hussein Mahammud on 31st
December 2021 and detaining her at Muthaiga Police Station for two days.
The arrest was allegedly meant to intimidate her from
pursuing an assault complaint against Abdihakim Saidi Jama.
The charge sheet states that the officers, “being police
officers within the National Police Service, intentionally and unlawfully
jointly ordered the arrest of Ayni Hussein Mahammud and detained her at
Muthaiga Police Station for two days with intent to intimidate her from
pursuing her complaint of assault against Abdihakim Saidi Jama.”
They also face a separate charge of unlawful arrest and
detention, which allegedly took place on the same day at Eastleigh-North Police
Station within Starehe Sub-County.
Following an investigation by the Independent Policing
Oversight Authority (IPOA), the Office of the Director of Public Prosecutions
(ODPP) approved charges against them.
When the case came up for plea on 13th February,
the officers wrote to the ODPP through their lawyer, Omwoyo Momanyi Gichuki
Advocates, seeking a review of the file.
They argued that certain facts had not been captured before
the file was approved for prosecution.
In response, the ODPP applied before Milimani Law Courts
Chief Magistrate Lucas Onyina to defer the plea for 30 days, stating that the
charges needed to be reviewed before the officers could take a plea.
The magistrate granted the application and ordered the
officers to be released on a Sh500,000 cash bail each.
The matter is scheduled for mention on 19th March
2025.
Ayni has dismissed the request for a review as a deliberate delay tactic, vowing to prove the officers wrong.
